The reason why you need “permission” from the state is because you’re entering into a legal contract, and the state (adminstrator/overseer of said contract) must first verify that there aren’t any existing contracts witch which the pending contract may conflict. It’s not as if the guy at the Clerk’s office can deny you the right to marry, unless you’re under 18 or already married.
